Would it be legal to setup a website to show prices of prescription drugs at various local retailers?
For example, if you are prescribed Drug X, you can go to my website and see that Walmart is selling it for $50, Walgreens is selling it for $75, CVS is selling it for $66?
Of course, the price information would have to come from other customers who live in that neighborhood. The strength of the website relies on the frequency of price reporting.
Are there any laws that would prohibit this? If I google “Dell PC Model # whatever, etc”, then they will give me several search results from all different stores offering their own price. But I was wondering if you’re allowed to do the same with prescription drugs.
I personally believe “Big Pharma” is the 3rd most powerful organization in the world (2nd to the U.S. banking lobby, and 1st to the U.S. Government itself). And I would assume they would be very careful to protect their profit margins, and would not be surprised if there was a law that prohibited anything that might help Americans save money on prescription medication.
I’d suggest that if you published the wholesale price of drugs you might expect to get some sternly worded letters written by lawyers from the pharmaceutical manufacturers. However powerful they are, I’d be really surprised to find it to be illegal.
On the other hand what you are proposing to do is publish the RETAIL price of the drugs. That pricing is reflective of the pharmacies (not the manufacturer). I’d suggest to you that unless you publish something that is libelous, you are in the clear.
Frankly I like the idea, in spite of it’s being a huge undertaking.
If we all became more responsible about our health care purchases…. including Rx drugs …. the country and our pocket books would be better for it. I’m all for price transparency, especially in health care.
